Introduction

Pashu Mandi - Cattle Bazaar welcomes you to our online platform. The phrases "we", "us", and "our" refer to Pashu Mandi - Cattle Bazaar throughout the whole website or associated app. By viewing our site/associated apps or buying something from us, you engage in our "Service" and agree to comply with the relevant terms and conditions ("Terms of Service", "Terms"), along with any terms of service and policies mentioned herein and/or accessible via hyperlink. Such Terms and Conditions apply to all customers of the site/associated mobile apps, including but not limited to to browsers, vendors, customers, merchants, and/or content contributors.

Agreement to Terms

1. 1The company holds the right to cease or revise the Terms and Conditions and Privacy Policy at any time if we believe that it is necessary or desirable. These modifications may include, among many other things, the addition and/or modification of prices, fees, and/or charges. Any such changes would take effect right after they were posted on the app. We recommend that you should go over the Terms and Conditions, Privacy Policy, and other modifications in our products, services, and fees on a regular basis to stay updated, and your ongoing use of the app after the modification becomes effective will constitute your affirmation and acceptance of the changes.
2. 2In the case of friction between both the Terms and Conditions and any other policies governing the site, the Clauses of the Terms and Conditions shall take precedence.
3. 3In pursuance of the provisions of the Information Technology Act of 2000, such Terms and Conditions comprise an electronic record.

Eligibility

1. 1The app is only accessible to those who can constitute legally enforceable agreements under applicable law. Individuals who are deemed 'incompetent to contract' under relevant laws, including un-discharged insolvents and persons of unsound mind, are not permitted to use the app. You can access the app only when you are over the age of 18, are competent to form contractual agreements under applicable laws, and are not forbidden by applicable laws from entering into a legally enforceable agreement.
2. 2If a minor (i.e. a child under the age of 18) or an individual incompetent to contract under relevant law accesses or uses the app, only the legal guardian/representative of such persons may enrol as a user and create/add the minor's profile. This does not relieve the legal guardian/representative, who is also an adult and of sound mind, of its responsibilities and liability to the company or its contractors or agents.
3. 3If the company finds that you are under the age of 18 and otherwise not capable of entering into contractual agreements, as required by the applicable law, the company reserves the right to cancel your account and subscription and refuse to provide you with the access of the app.
4. 4You admit that the company is not accountable for maintaining that you comply with the aforementioned eligibility requirements. It is wholly your obligation to make sure that you have the required qualifications.

Services Offered

1. 1An electronic trading platform for animals (primarily livestock) that enables you to browse a list of animals and buy them online. You can also set up an account on the Pashu Mandi - Cattle Bazaar app to perceive the list of animal details or information given by a customer on the app.
2. 2A platform under which livestock feed can be scrolled and bought; you could also enrol on the app and perceive a list of livestock feed available to buy from multiple brands.

User Agreement

You agree, pursue, and verify that your usage of the app is governed by the respective binding guidelines:

1. 1Individuals are not permitted to host, display, upload, modify, publish, transmit, update, or share any information that belongs to another person and over whom they have no authority.
2. 2Is massively hazardous, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invading someone else's confidentiality, hateful, or racially or ethnically objectionable.
3. 3Is misleading in any way.
4. 4Includes sending "junk mail", "chain letters", or uninvited mass mailing or "spamming".
5. 5Encourages illegal activities or behaviour that is abusive, threatening, obscene, defamatory, or libellous.
6. 6Infringes or breaches any third party's rights, including but not confined to intellectual property rights, privacy rights or publicity rights.
7. 7Shall not be untrue, incorrect, or deceptive.
8. 8Shall not subject us to liability.
9. 9Any supplemental terms and policies or documents posted on the app on a regular basis are expressly integrated by references herein.

Information You Provided to Us

You guarantee and warrant that:

1. 1All registration status you submit is real, accurate, existing, and complete, and relates to you and not a third party.
2. 2You will sustain the correctness of such details and immediately update such information as necessary.
3. 3You will keep your password confidential and will be liable for all use of your password and account.
4. 4You have the legal authority and accept to comply with these Terms and Conditions.
5. 5If you submit false, inaccurate, out-of-date, or incomplete information, we may suspend or cancel your account.

The Content You Provide to Us

1. 1You could be able to upload content to the app (including animal listings) or give feedback to us ("User Content"). You recognize and acknowledge that the other customers on the app may view your User Content and might be able to see who posted that User Information.
2. 2You also agree that we may use your User Information for any other reason in perpetuity without compensation to you and that we can merge your User Information with some other content for use on the app and elsewhere.
3. 3We reserve the right to remove any User Content you post on the app if we believe it does not abide by these Terms and Conditions.
4. 4If you wish to lodge a complaint about User Content posted by other users, please contact us at info@pashumandi.in.

Link to Third Party

1. 1The app may include links to third-party websites or applications. We have no authority or influence over any such third-party websites or applications, nor do we have any control over the third-party content.
2. 2We are not liable for any advertisements that appear on the app. You agree to buy goods and/or services from any third party who tries to promote on the app at your own risk.

App Management

1. 1We retain the right, at our absolute discretion, to (1) supervise the app for infringements of the Terms and Conditions; (2) take appropriate legal steps against anyone who violates relevant laws or these Terms and Conditions; (3) reject, limit access to or accessibility of, or disable (to the extent technologically feasible) any of your accounts; and (4) eliminate from the app or otherwise deactivate all files and content that are extreme in size or are otherwise a burden to our servers.
2. 2We make no assurance that the app will be protected or free of bugs or viruses.
3. 3You must configure your information technology, computer programmes, and platform to access the app, and you must use your own well-equipped virus protection software.

Modifications to and Availability

1. 1We hold the right, at our absolute discretion, to change, modify, or remove the entire content of the app at any time and for any reason. We also retain the right, at any time, to change or discontinue all or part of the Services without notice.
2. 2We cannot guarantee that the app and Services will always be available. We may encounter hardware, software, or other issues, or we may need to perform app maintenance, which may result in disruptions, delays, or errors.
3. 3There might be typographical errors, inaccuracies, or omissions in information on the app relating to the Services, such as descriptions, pricing, availability, and other information.

Severability

If any of the provisions or requirements of these Terms and Conditions is held by a court of competent jurisdiction or an arbitral tribunal to be unenforceable under applicable law, such provision will be exempt from these Terms and Conditions, and the remainder of the Terms shall be viewed as if such provision had been so excluded, and shall be enforceable in conformity with its terms.

Terms and Termination

1. 1All such Terms and Conditions will continue to apply when you access the app or Services or are otherwise a customer of the app, as relevant. You may discontinue use or involvement at any time and for any reason by following the steps for terminating user profiles in your account settings, if accessible, or by contacting us at info@pashumandi.in.
2. 2Without confining any other provision of these Terms and Conditions, we retain the right to refuse access to and use of the app and Services (including blocking specific IP addresses) to any individual for any reason.
3. 3If we ascertain, in our absolute discretion, that your access to the app/Services is an infringement of these Terms and Conditions or any applicable legislation or regulation, we may discontinue your use or involvement in the app and the Services, as well as delete your profile and any content or details that you posted, at any point of time and without any prior notice.
4. 4If we cancel or suspend your account for any of the purposes listed in this section, you are forbidden from registering and establishing a new account using your phone number.

General Terms

1. 1Electronic communications include using the app, sending us emails, and submitting online forms. You consent to receive online information and accept that all contracts, notices, disclosures, and other communications that we provide you electronically fulfill any laws and regulations that such communication is in writing.
2. 2These Terms and Conditions, together with any policies or regulations imposed by us on the app or in relation to the Services, represent the complete agreement and understanding between you and Pashu Mandi - Cattle Bazaar.
3. 3Failure by us to exercise or impose any right or provision of these Terms and Conditions does not entail a waiver of that right or provision.
4. 4At any point in time, we may assign any or all of our rights and responsibilities to others.
5. 5We shall not be liable or accountable for any loss, damage, delay, or failure to act caused by any cause beyond our proper control.

Disclaimer / Limitation of Liability

1. 1In no event, including but not limited to negligence, shall Pashu Mandi app, or any of its directors, officers, employees, agents or content or service providers be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the Site or the content, materials and functions related thereto.
2. 2The Protected Entities shall not be liable for provision of or failure to provide all or any service by Practitioners to You contacted or managed through the Site.
3. 3Pashu Mandi - Cattle Bazaar app does not support or promote any kind of animal cruelty. We shall not be responsible for any offence related to animal cruelty if committed by any of the users.
4. 4The information provided by us on the app in relation to the products and/or animals is on an 'as is basis' and it shall be your sole responsibility to verify the information listed on the app with the seller.

Jurisdiction and Governing Law

1. 1These Terms and Conditions, their subject matter, and their formation are governed by Indian law.
2. 2We both accept that the courts of Sirsa, India, will have exclusive jurisdiction.
